nautical miles offshore to include the waters of the territorial sea. There are three district councils within the region — New Plymouth, Stratford and South Taranaki district councils. The area of Stratford district to the east of Pohokura Saddle falls into Manawatu-Whanganui (Horizons) region. Taranaki can offer residents and visitors the opportunity to surf and ski on the same day. Taranaki consists of four distinctive landforms, each of which requires a different type of environmental management.
These legal submissions are made on behalf of Taranaki Regional Council (TRC)
and address the following questions that have arisen during the hearing:
(a) Does the existing environment include the effects of the existing consent?
(b) Is it open to the hearing panel to apply a permitted baseline?
(c) Does the proposed activity fall within Rule 52 of the Regional Air Quality
Plan for Taranaki (RAQP)?
(d) Is possible future residential zoning of the surrounding area part of the
whitewater activities below the tailrace

1.3 Resource consents
1.3.1 Water abstraction permit (groundwater)
Section 14 of the RMA stipulates that no person may take, use, dam or divert any
water, unless the activity is expressly allowed for by a resource consent or a rule in a
regional plan, or it falls within some particular categories set out in Section 14.
The Council determined that the application to take groundwater fell within Rule 49 of
the Regional Freshwater Plan for Taranaki
Internal roads and tracks are to be maintained to ensure that silt or split waste does not
enter the Haehunga Stream. The Site Manager to check the tracks daily during rain events
otherwise weekly.

On residential properties nearest to the Dow plant, soil dioxin concentrations were typically in the
range 5 to 15 ng/kg of soil, falling to a range of 1 to 5 ng/kg further out. One sample had a
