control of DWI activities through the resource consenting process and subsequent
compliance monitoring is an appropriate regulatory regime. In the Taranaki region,
the discharge of contaminants by DWI requires resource consent from the Council.
The activity falls under Rule 51 of the Regional Freshwater Plan for Taranaki and is
classified as a discretionary activity. The application may be non-notified if no parties
are deemed to be adversely affected by the proposed activity.

1.3 Resource consents
1.3.1 Water abstraction permit
Section 14 of the Resource Management Act stipulates that no person may take, use,
dam or divert any water, unless the activity is expressly allowed for by a resource
consent or a rule in a regional plan, or it falls within some particular categories set
out in Section 14.

Fonterra holds water permit 0047 to cover the abstraction of water from the Tawhiti
Stream (Photograph 2), a tributary of the Tangahoe River, for the processing and
manufacture of dairy products, cleaning of plant, and cooling purposes. This permit
