Eventually, given enough time and a high-enough rate of spin and stretching, the tornado’s
funnel lengthens to the ground, and with it come the high-speed potentially-damaging winds.
By contrast, winds in the limited area at the middle of a tornado funnel are light, if not
approaching calm at the epicentre, as with the eye of a tropical
consent holder and unforeseeable (i.e. a
defence under the provisions of the RMA can be established) may be excluded with
regard to the performance rating applied. For example loss of data due to a flood
destroying deployed field equipment.

1.3.2 Water abstraction permit (groundwater)
Section 14 of the Act stipulates that no person may take, use, dam or divert any
water, unless the activity is expressly allowed for by resource consent or a rule in a
regional plan, or it falls within some particular categories set out in Section 14.
The Council determined that the application to take groundwater fell within Rule 49
of the Regional Freshwater Plan for Taranaki (RFWP) as the rate and daily volume of
the groundwater abstraction
irrigation or
municipal water supply to enable them to
comply with any consent limits. It is also
important for ensuring that water allocated
for use is done so in a way that provides for
other freshwater values, such as ecosystem
health.
Under the NPS-FM, water use is managed
by setting environmental flows and levels,
taking into account any changes that are
likely to occur as a result of climate change.
Limits can then be set on the rate and
amount of water taken, and where and
when
directions. It is crucial to note that these confidence levels and resultant trend categories do not reflect the
rate of change itself. Some sites may exhibit minor changes but with a high confidence in either
improvement or degradation.
For this SoE report the categories have been streamlined into five categories to capture the overall trend,
aligning with LAWA trend categories (LAWA, 2023). Trends indicating a likelihood of 90% and 100% are
classified as ‘very likely improving’. Those showing a
utilisation, to move closer to achieving sustainable development of the region’s resources.
